These Terms of Service ("Terms") constitute a legally binding agreement between you and HE Solutions, LLC ("Company," "we," "us," or "our"), governing your access to and use of the Unstuck mobile application and website at tryunstuck.app (collectively, the "Service").
By downloading, installing, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old (or the minimum digital age of consent in your jurisdiction) to use the Service.
Unstuck is a voice-based AI productivity tool designed to help users overcome task avoidance and initiate action by breaking tasks down into smaller, manageable steps through conversational AI.
The Service is not a substitute for professional mental health care, therapy, psychiatric treatment, or medical advice. If you are experiencing significant mental health difficulties, including severe anxiety, depression, ADHD, or other conditions, please seek help from a qualified healthcare provider. Unstuck is a productivity tool only.
You may sign in to the Service using Apple Sign In. You are responsible for maintaining the security of your device and any credentials used to access the Service. You must promptly notify us at support@tryunstuck.app if you suspect unauthorized access to your account.
You may not share your account with others or create multiple accounts to circumvent subscription restrictions.
Certain features of the Service require a paid subscription. Subscriptions are offered as auto-renewing plans through the Apple App Store, processed via a third-party subscription management service.
Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the renewal date. Billing is charged to your Apple ID account. Prices are subject to change upon reasonable notice.
All purchases are processed through the Apple App Store. Refund requests must be submitted to Apple in accordance with their refund policy. We do not have the ability to issue refunds directly. We do not offer refunds for partial subscription periods or unused access.
If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial unless cancelled before the trial period ends.

The Service uses artificial intelligence (powered by third-party AI service providers) to process your voice input and generate responses. You acknowledge that:
By using the voice feature, you grant us a limited, non-exclusive license to process your audio input solely for the purpose of delivering the Service to you. We do not use your content to train AI models without your explicit consent.
The Service, including its design, code, branding, text, and AI-generated responses, is owned by or licensed to HE Solutions, LLC and is protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
You retain ownership of any content you input into the Service. By using the Service, you grant us a limited license to process and store that content solely to provide the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.
WE MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT GENERATED BY THE AI SERVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, HE SOLUTIONS, LLC AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING LOSS OF DATA, LOST PROFITS, OR PERSONAL INJURY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) FIFTY DOLLARS (USD $50).
You agree to defend, indemnify, and hold harmless HE Solutions, LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
The Service integrates with various third-party services for functionality such as authentication, AI processing, subscription management, data storage, and analytics. Your use of those services is governed by their respective terms and privacy policies, and we are not responsible for their conduct.
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violations of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 8, 9, 10, and 13 survive termination.
You may stop using the Service at any time. To delete your account and associated data, contact us at support@tryunstuck.app.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.
Any dispute arising from these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights.
We may modify these Terms at any time. When we do, we will update the "Last updated" date and, for material changes, notify you via the app or email. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
